Services Terms & Conditions
At Passion for Pixels, we strive to provide you with a seamless and satisfactory experience. By placing an order with us, you are agreeing to our Service Terms & Conditions, designed to outline the terms of our collaboration and to ensure your understanding of the process. Here's what you can expect:
We enter into a non-exclusive contract to digitize and organize your photos onto a USB flash drive and a server in the CLOUD.
Throughout the process, we maintain open communication, providing tracking and regular updates for your order.
You agree not to send us photos that:
- violate copyright laws; and/or
- are obscene, offensive or violate state or federal law or a third party.
Federal copyright law mandates permission from the photographer to scan, copy, or reproduce copyrighted photographs and images. By placing an order, you affirm that you have obtained the necessary permissions.
We will not knowingly scan copyrighted photos. If such photos are discovered, we are obligated to comply with applicable laws and report the information to relevant authorities.
In the event of legal disputes arising from the submission of copyrighted photos, you and/or the copyright holder assume responsibility for all associated costs.
Access to Your Photos Online
For the initial year, we will securely store your photos on our Cloud site. This service is provided through a third-party provider, SmugMug.
You acknowledge that we do not have control over the online hosting at our Cloud provider and assume no liability or control over your photos on that site.
You agree to hold us harmless for any potential actions, such as loss, destruction, or unavailability, that may occur to your photos on this external site.
You have the option to continue using our Cloud service beyond the first year. If you choose this service, your credit card on file will be automatically charged $11.99 annually for renewals. You can cancel this service at any time by emailing us at email@example.com.
We utilize USPS Priority Mail for shipping our bulk photo scanning packages. USPS offers customers $100 insurance on Priority Mail packages.
While we strive to ensure the safe delivery of your photos, we cannot guarantee that they will not be damaged or lost during transit. Therefore, we do not assume responsibility for loss or damage and you agree to not hold our company liable in such cases.
Your online bulk photo scanning order is valid for a one-year period (365 days). Please ensure that you send your photos to us in the provided box or a similar-sized USPS box.
If you selected the local option, you have one year to schedule your pickup with us. Beyond this timeframe, we cannot guarantee a refund.
If you discover any issues with your completed order, please reach out to us, and we will make every effort to resolve the matter. If we are unable to rectify the situation, our refund policy is as follows:
- You have the choice of receiving 100% of your purchase back as store credit; OR
- You can opt for a refund, with a deduction of a $30 fee for every 2,500 photos scanned.
- For instance, if you scanned 5,000 photos, we will refund your entire purchase minus a $60 fee ($30 x 2) to cover shipping and thumb drive costs.
- The minimum refund fee is $30.
Should you choose to refund your purchase, please note that we will also remove your photos from our Cloud drive.
Your satisfaction remains our priority, and we aim to address any concerns promptly and fairly.
When you entrust your photos to our care, it signifies your understanding and agreement to the following terms:
You acknowledge that any potential loss or damage, whether incurred by our company or its agents, shall not entitle you to recovery, and we do not provide any warranty. Our service is offered 'as is' and without fault. You consent to being limited to store credit up to the amount of the disputed transaction, with no additional punitive damages (whether direct or indirect) awarded.
That being said, we will provide you with our best service, and our goal is to protect your photos in every way possible. However, it's important to note that we cannot assume responsibility or liability in the following circumstances:
Loss or damage arising from an act of God or natural disaster. This includes any outages or unforeseen events occurring at third-party hosting sites that we may employ as part of our service.
